“QDRO” is a federal term for certain private-employer retirement plans. CalPERS, CalSTRS, federal civilian retirement, the Thrift Savings Plan, military retired pay, Railroad Retirement, Social Security, and IRAs use different statutes, procedures, or order types.
We do not decide which order you need or what division formula protects your rights. Once you, your attorney, the court, or an authorized self-help resource provides the necessary direction, we can prepare and format the requested paperwork.

Legal Document Assistant services are provided to the public. Paralegal services are only provided to licensed attorneys.

What is a QDRO?
A Qualified Domestic Relations Order is a court order that can assign a spouse, former spouse, child, or dependent a right to receive part of a participant’s benefit under certain employer retirement plans. The plan administrator determines whether an order satisfies federal and plan rules.
Do all retirement accounts use a QDRO?
No. Governmental, federal, military, railroad, Social Security, and IRA interests follow different rules or documents. We cannot select the correct document for you; you may obtain direction from an attorney, the court, the plan, or an authorized self-help resource.
Can you tell me which division formula or survivor option to use?
No. Those decisions require legal advice. We prepare documents from the formula and options you select or from written instructions supplied by your attorney, judgment, court, or authorized source.
Can you choose the forms or appear in court for me?
No. Legal Document Assistants cannot select forms, give legal advice, choose strategy, or represent customers in court. We prepare customer-selected documents in a ministerial manner at the customer’s specific direction.
What if the plan requests changes?
We may make ministerial changes that follow the plan’s written instructions and remain consistent with your direction. If the requested change affects legal rights or requires a new choice, you should obtain attorney direction.
How long does the process take?
Draft preparation depends on document completeness and scope. Court and plan processing times are outside our control and may take weeks or months. No outcome or completion date is guaranteed.
Can the work be handled remotely?
Usually. California clients can generally send records, review drafts, and receive completed documents by phone and electronic exchange. Original signatures, notarization, service, or a court’s local procedure may require additional arrangements.
